We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use our Services for your personal or internal business purposes, subject to these Terms. This licence does not include any right to sublicense, sell, resell, transfer, assign, or commercially exploit any content from our Services.
The personalised energy reports we generate for you are created based on the data and information you provide to us. You retain ownership of the underlying data you provide. We retain ownership of the analysis, methodology, and presentation contained in the reports we generate.
You grant us a non-exclusive licence to use the data you provide for the purpose of generating your reports, improving our analytical methodology, and producing anonymised statistical research. We will handle your data in accordance with our Privacy Policy.
Some of our Services are provided free of charge, while others are available on a paid subscription or one-time fee basis. The fees applicable to paid Services are clearly stated at the point of purchase. All fees are quoted exclusive of applicable taxes, which will be added at checkout.
Payment for paid Services is due in advance. We accept major credit and debit cards and other payment methods as indicated at checkout. By providing payment information, you authorise us to charge the applicable fees to your chosen payment method.
If you are not satisfied with a paid report or service, please contact us within 14 days of purchase at [email protected]. We will review your request and, where appropriate, provide a refund or credit at our discretion. This does not affect any statutory rights you may have as a consumer.
Our Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that our Services will be uninterrupted, error-free, or free from harmful components. We do not warrant the accuracy, completeness, or suitability of any information or analysis provided through our Services for any particular purpose. All energy savings estimates and financial projections are indicative only and actual results may differ materially.
To the maximum extent permitted by applicable law, Energy Reports and its directors, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services, including but not limited to loss of profits, loss of data, loss of goodwill, or the cost of substitute services.
Our total liability to you for any claim arising out of or related to these Terms or our Services shall not exceed the greater of: (a) the total amount you have paid to Energy Reports in the twelve months preceding the claim; or (b) $100 USD.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so the above limitations may not apply to you in full. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
Your use of our Services is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the collection, use, and sharing of your personal information as described in the Privacy Policy.
